SB17 (Texas Education Code § 51.3525) became effective January 1, 2024. This statute
requires strict compliance by the UNT System and component universities.
The Office of Institutional Integrity and Awareness (OIIA) has created two flow charts to
assist you in reviewing your unit’s current or prospective activities, trainings,
or programs. The first chart serves only as a preliminary compliance assessment and will assist you in determining
whether an activity is permitted or prohibited under the provisions of Texas Education
Code § 51.3525. The second Flow Chart helps in determining the activity exclusions. OIIA may contact you about your submission
to gather additional information if necessary.
OIIA also requests that you document your review process since the State Auditor’s
Office will be conducting a mandatory audit of our compliance with this statute in
the future. The SB17 Compliance Log is available to help you in compiling your data.
If you require clarification on terms or phrases used in the flow charts or if you
encounter activities that are not covered clearly, please email compliance@unthealth.edu. OIIA will continue to serve as a clearinghouse for issues that require a review
by the Office of General Counsel (OGC). You may also find additional guidance on OGC’s Senate Bill 17 Guidance/FAQs webpage.
Compliance with TEC § 51.3525 is a priority for the university, as failure to comply
could result in loss of state funding. Therefore, employees who fail to comply will
be subject to disciplinary action, including termination.
